Fair use rationale for use in the article Einstein

Even though the media Einstein tongue.png is copyrighted and not released under a free license, I, Carpetsmoker, feel it is covered by fair use for at least one of the following reasons:

• No free alternative exists.
• The subject of the photograph is deceased, therefore a "new" image can not be created of this person.
• The image is of significantly lower resolution than the original (copies made from it will be of inferior quality).
• Fair use rationale lifted from Wikipedia:

• This is a world-famous photo of a non-repeatable historic event that is iconically associated with Albert Einstein.
• The image is discussed in the article and is needed to demonstrate Einstein's prominence in pop culture.
• This is the most famous image of Albert Einstein in popular culture and is not replaceable with a free image.
• The image cannot be conveyed in another form (either text or another image) since the image itself is discussed in the article.
• This is a low resolution version of the image, not likely to infringe the selling rights of the photographer.
• The commercial value of the photograph is not significantly reduced by its use on the article

• The placement in a RationalWiki article is being used for informational purposes only, and its use is not believed to detract from the original copyrighted media in any way.
• A free alternative may not exist now, but in the event of a free alternative being located for the article "Einstein" in the future, this file should be deleted as soon as possible.
